Terms of use
Effective October 2026. Please read these terms before using MemberVerdict.
1. Who we are and agreement
MemberVerdict is operated by MemberVerdict LLC, a Kansas limited liability company ("MemberVerdict", "we", "us"). These terms apply to memberverdict.com, the MemberVerdict member tool wherever it is embedded, the customer portal, the partner portal and every paid service we provide (together, the "service"). By using the service, creating an account, ticking "I agree" at payment or paying an invoice, you agree to these terms. If you use the service for an organization, you confirm you are authorized to bind it, and "you" includes that organization.
MemberVerdict provides an unbiased, accurate rate and price index for members. It is not an insurance producer, agent or broker. Coverage is purchased through each program's licensed administrator.
Please read section 12: it requires disputes to be resolved by individual arbitration and waives class actions and jury trials.
2. The service
MemberVerdict rates group insurance programs sold through associations, scores the options for a member's situation, and sells Rate Comparison Reports, rate monitoring, member quote introductions and software to associations, licensed agents and program administrators.
We do not sell, solicit, negotiate, bind or service insurance, and we do not receive commissions from carriers, brokers or administrators. MemberVerdict is not an insurance agent, broker or insurance consultant: our reports, including the Rate Comparison Report and rate monitoring, are comparisons compiled from publicly published rates and plan information, not consulting services or advice about any policy. Scores, the MV Assistant, snapshots and reports are general information to help you compare; they are not insurance, financial, tax, legal or professional advice for any individual situation, and they are not an offer or a guarantee of coverage or price. Enrollment, eligibility, final rates and policy terms are set only by each program's administrator and carrier. You are responsible for your own decisions and for reading the actual policy documents.
Member quote introductions are not offered at launch. If they are offered, when a member asks to be introduced to a licensed agent, we pass the request to one independent agent. Agents are not our employees or representatives; we do not supervise, endorse or guarantee their advice, licensing, conduct or the products they sell, and anything you arrange with an agent is between you and the agent.
3. Accounts
You must be at least 18 to create an account. Give accurate information, keep your password private and tell us at support@memberverdict.com if you think someone else has used your account. You are responsible for all activity under your account. Licensed agents must hold the licenses the law requires in every state where they accept member quote requests, and must keep them current.
4. Fees, invoices and payment
Paid services are priced as shown on our Pricing page or in your invoice. Invoices are due by the date shown and may be paid by card through our payment processor, Stripe, or by bank transfer or check. We never charge a card automatically; yearly rate monitoring is renewed by a new invoice before the year ends, and you may decline it. Prices exclude any taxes that apply, and you pay any bank, wire or currency fees on your side.
Every service is paid in advance. Work starts, and reviews, monitoring, introductions and software become available, only after your payment is received in full. If an invoice is not paid, the service is not provided; if a renewal is not paid by its due date, the service stops on that date. Nothing is owed by MemberVerdict for any period that was not paid for.
Rate Comparison Report fees are earned when the review is delivered. Member quote introduction fees are earned when the agent accepts the introduction. All payments are final and non-refundable. This includes Rate Comparison Report fees, rate monitoring, member quote introduction fees and any other paid service, whether or not you use the service, disagree with its findings, change your plans or close your account early. We do not give partial refunds or credits. Where a law that cannot be waived requires a refund, only the minimum that law requires applies.
Late invoices may be suspended and sent to collection. You agree to pay reasonable costs of collecting unpaid amounts, including collection agency and attorney fees, to the extent the law allows.
5. Payment disputes and chargebacks
If you have a problem with a charge, you agree to contact us first at support@memberverdict.com and give us 30 days to resolve it before asking your bank or card issuer to reverse it. Filing a chargeback for a service that was delivered, or for a charge you authorized, breaks these terms. In that case we may suspend your access (including to reports already delivered), contest the chargeback with the records we keep (your acceptance of these terms at payment, invoices, receipts, delivery and usage records and correspondence), and recover the amount, the processor's dispute fees and our reasonable collection costs. You authorize us to share those records with Stripe and the card networks for that purpose.
6. Sales partners
Sales partners are independent contractors, not employees, agents or legal representatives of MemberVerdict. They may not make promises, change prices or terms, or bind MemberVerdict in any way; only a written invoice or agreement from MemberVerdict does. Partners are responsible for their own taxes on commission (Stripe or MemberVerdict may issue tax forms such as a 1099).
Commission is earned only on payments MemberVerdict actually receives and keeps. If a sale is charged back, disputed, refunded, reversed or found to be fraudulent, the commission on it is returned to MemberVerdict: we take it back from the partner's payout account, deduct it from future commission, or both, and the partner repays any amount still owed within 30 days of our request. No commission is paid on purchases billed to the partner, to anyone on our team, or arranged to earn commission on the partner's own purchase. Commission on card payments may be held for 7 days after the customer pays. Commission obtained by false information, self-dealing or breaking these terms is forfeited, and we may remove the partner and recover it.
Partners keep customer and prospect information confidential, use it only to sell MemberVerdict services, and return or delete it when they leave.
7. Acceptable use
Do not copy or scrape the site or the Price Index at scale, resell our data, attempt to disrupt, overload, probe or reverse-engineer the service, get around payment or security controls, upload anything unlawful or harmful, impersonate anyone, or enter another person's personal information without permission. Members who request a quote agree to be contacted by the one agent the request is introduced to.
8. Intellectual property
The MemberVerdict name and logo, the scoring method, software, reports and the compiled MemberVerdict index belong to MemberVerdict LLC. Customers may share their own Rate Comparison Report and snapshot inside their organization and with their carrier or administrator, but may not publish or resell them. Program and carrier names belong to their owners. If you send us feedback or suggestions, we may use them freely.
9. Disclaimers
We verify the rates in the MemberVerdict index and date them, and we correct errors promptly when told about them at support@memberverdict.com. Rates and program terms come partly from third parties and change without notice, so we do not guarantee that any information is complete, current or error-free, or that any rate will be available to you.
To the fullest extent the law allows, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, title and non-infringement, and without any promise that it will be uninterrupted, secure or free of errors.
10. Limitation of liability
To the fullest extent the law allows, MemberVerdict LLC, its owners, members, managers, employees, contractors and sales partners have no liability to you or anyone else, and our total liability for all claims of any kind, together, is one dollar ($1). This covers direct, indirect, incidental, special, consequential, exemplary and punitive damages, lost profits, lost savings, lost premiums, lost data and business interruption, and any decision you or your members make based on the service, whether the claim is in contract, tort, negligence, strict liability or any other theory, even if we were told the loss was possible.
If a court decides this limit cannot apply in full, our total liability is limited to the smallest amount that law allows. You agree these limits are a basic part of our prices and that we would not offer the service without them. Some places do not allow certain limits; there, the limits apply as far as the law allows.
11. Indemnity
You agree to defend, indemnify and hold harmless MemberVerdict LLC and its owners, employees and contractors from any claims, losses, damages, fines, costs and fees (including reasonable attorney fees) arising from your use or misuse of the service, the information you provide, your dealings with agents, carriers, administrators or your members, a chargeback you file in breach of section 5, or your breach of these terms or the law.
12. Disputes, arbitration and class-action waiver
Before starting any claim, you agree to email us a description of the dispute and give us 60 days to try to resolve it informally.
Any dispute that is not resolved will be settled by binding individual arbitration administered by the American Arbitration Association under its applicable rules, before one arbitrator, in Kansas or by video. Either side may instead bring an individual claim in small-claims court. The arbitrator may award only individual relief and may not combine claims. You and we each waive any right to a jury trial and to take part in a class, collective or representative action. If this waiver is found unenforceable for a claim, that claim goes to the courts in section 13 and not to arbitration. MemberVerdict may still go to court to collect unpaid amounts or to protect its intellectual property.
Any claim must be brought within one year after it arises, or it is permanently barred, to the extent the law allows.
13. Governing law
These terms are governed by the laws of the State of Kansas and applicable federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules. Subject to section 12, any court case will be heard only in the state or federal courts located in Kansas, and you consent to their jurisdiction.
14. Suspension and termination
You may close your account at any time by emailing us; amounts already invoiced or paid remain due and non-refundable. We may suspend or close any account, at any time, that breaks these terms, leaves invoices unpaid, files a chargeback in breach of section 5, or puts the service or other users at risk. Sections 4 to 6 and 8 to 15 continue after an account is closed.
15. General
Electronic communications. You agree to receive invoices, receipts, notices and these terms electronically, and that ticking "I agree", clicking to accept or paying an invoice is your electronic signature. Entire agreement. These terms, any invoice and any written agreement signed by MemberVerdict are the whole agreement; if they conflict, the signed agreement, then the invoice, then these terms apply. Severability. If any part is found unenforceable, it is limited only as much as needed and the rest stays in force. No waiver. Not enforcing a term is not a waiver of it. Assignment. You may not transfer these terms without our written consent; we may transfer them with our business. Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, including outages of hosting, payment or email providers. No third-party rights. No one else may enforce these terms. Headings are for convenience only.
16. Changes
We may update these terms. The date at the top shows the latest version; material changes are announced on the site or by email to account holders before they take effect, and apply to use and payments after that date. Continuing to use the service after a change means you accept it.
